Under Chapter 13, you continue to pay secured debts such as your mortgage(s), federal tax obligations, student loans, and certain other debts. Your unsecured debts such as credit card debt will be reorganized in a three- to five-year payment plan by the Chapter 13 Trustee. Generally, a portion of your unsecured debt may be discharged and you will pay a percent of this debt directly to the Trustee in payments spread out equally over the length of your payment plan. The Trustee will then distribute these funds among your creditors.

While this process is going on, it is important that you follow the repayment plan religiously. If you are going to have trouble making a scheduled payment to any creditor during this time, it is important that you communicate that to the Trustee as soon as you become aware there may be a problem. If any creditors call you and try to make other arrangements during this time, it is important that you simply refer them to your attorney rather than speaking with them yourself.
